TERMS OF SERVICE

1. Acceptance of Terms

By accessing and using the Tender Manager platform ("the Service"), provided by Mahanaim Empire (Pty) Ltd ("the Company"), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

The Service allows users to manage tender documentation, generate proposals using Artificial Intelligence (AI), and store compliance documents. The Company provides the platform on a Software-as-a-Service (SaaS) basis.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are fully responsible for all activities that occur under your account.
• The Company reserves the right to terminate accounts that violate these terms or engage in illegal activity.

4. Payment and Subscriptions

• The Service is billed on a subscription basis (Monthly or Annually).
• Payments are processed securely via PayFast or Direct Bank Transfer.
• Failure to pay subscription fees will result in the suspension of access to the Service.
• Setup Fee: A one-time setup fee of R250 applies to all new accounts.

5. Data Privacy and Security

Your use of the Service is also governed by our Privacy Policy. We are committed to protecting your data in accordance with POPIA.

6. Use of AI Tools

The Service includes AI-powered tools for proposal generation. You acknowledge that:

• AI-generated content is provided for assistance purposes only.
• You are responsible for reviewing, verifying, and editing all AI-generated content before submission.
• The Company accepts no liability for errors or omissions in AI-generated proposals.

7. Intellectual Property

The Service, including its code, design, and branding, is the property of Mahanaim Empire (Pty) Ltd. You retain ownership of the data and documents you upload to the Service.

8. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, distinctive, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms of Service.
